Terms of Service
Last updated: April 2026
1. Acceptance of Terms
By creating an account or using the friendr. platform (the “App” or “Platform”), you agree to be bound by these Terms of Service (“Terms”) and all policies incorporated by reference, including our Privacy Policy and Cookie & Tracking Policy. These Terms constitute a legally binding agreement between you and Friendr LLC. If you do not agree, you must not use the Platform.
IMPORTANT — DISPUTE RESOLUTION: Please carefully review Section 18 (Informal Dispute Resolution) and Section 19 (Binding Arbitration & Class Action Waiver). These sections require that most disputes be resolved through individual binding arbitration rather than in court, and waive your right to a jury trial and class action participation.
2. Eligibility, Representations & Warranties — 18+ Only
You must be at least 18 years of age to create an account or use friendr.. By using the Platform, you represent and warrant that:
(a) You are at least 18 years of age and have the legal capacity to enter into a binding agreement;
(b) All information you provide to Friendr or to other users is accurate, current, and not misleading — including your name, age, identity, and profile photos;
(c) You have not been convicted of, or pled no contest to, any felony or any crime involving violence, threats, sexual misconduct, or harm to a minor;
(d) You are not required to register as a sex offender under the laws of any jurisdiction;
(e) You do not have any other active accounts on the Platform that were terminated by Friendr for violations of these Terms;
(f) You will promptly update your account information to keep it accurate.
If Friendr discovers that a user is under 18 or has misrepresented any of the above, Friendr will immediately terminate that account and delete all associated data without notice. Do not use this Platform if you are under 18.
3. Nature of the Platform
friendr. and Friendr LLC (“Friendr,” “we,” “us”) operate a social coordination platform that allows users to organize and discover in-person meetups (“Hangouts”) and recurring groups (“Crews”). Friendr is not an event organizer, venue operator, host, promoter, or participant in any Hangout or Crew activity. Friendr acts solely as a neutral technology platform connecting users and is not liable for the actions, conduct, or content of its users.
Subscription note: Friendr may offer an optional paid subscription (“Friendr Support”) that unlocks cosmetic themes and supports platform development. Purchasing a subscription does not affect your ability to create Hangouts, join Crews, message other users, or appear in any listing. Friendr will never place core social features behind a paywall.
4. User Accounts, Content Moderation & Termination
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at daniel@joinfriendr.com.
Content moderation: Friendr reserves the right — but has no obligation — to review, monitor, remove, limit, block, or refuse to display any User Content at any time and for any reason, in our sole discretion, without prior notice or liability to you. We have no obligation to store, maintain, or make available any User Content after it is removed. If your content is prohibited under the laws of any jurisdiction where the App is available, we may remove it even if it is not unlawful in your location.
Termination: Friendr reserves the right to suspend or permanently terminate any account at any time, for any reason, including violation of these Terms, without prior notice or liability. Upon termination, your license to use the Platform immediately revokes.
5. User Content License
By posting content on the Platform — including photographs, text, hangout descriptions, chat messages, and any other materials (“User Content”) — you grant Friendr LLC a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, store, display, reproduce, modify, and distribute your User Content solely for the purposes of operating, improving, and promoting the Platform. You represent and warrant that you own or have obtained all rights necessary to grant this license, and that your User Content does not infringe any third-party intellectual property rights, privacy rights, or other rights. You are solely responsible for your User Content and any consequences of posting it.
6. DMCA / Copyright Infringement
Friendr complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) and responds to valid takedown notices. If you believe your copyrighted work has been infringed on the Platform, please send a written notice to our designated agent at daniel@joinfriendr.com that includes: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the infringing material and information sufficient to locate it on the Platform; (3) your contact information (name, address, phone, and email); (4) a statement of your good-faith belief that the use is not authorized; and (5) a statement, made under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf. Counter-notifications may be submitted to the same address. Repeat infringers will have their accounts terminated.
7. Prohibited Conduct
You agree not to:
Use the Platform for any unlawful purpose or in violation of any applicable local, state, or federal law or regulation; harass, threaten, stalk, intimidate, bully, assault, or harm any other user on or off the Platform; impersonate any person or entity, or misrepresent your identity, age, background, or affiliations; scrape, data-mine, reverse-engineer, decompile, or otherwise attempt to extract the Platform’s source code, algorithms, or user data without authorization; use the Platform if you are under 18 years of age; organize, facilitate, attend, or promote any meeting or event involving a minor; transmit any malicious code, viruses, worms, Trojan horses, or other harmful software that could compromise the Platform or its users; use any automated tools, bots, crawlers, or scripts to access or interact with the Platform; solicit money, gifts, loans, or items of value from other users; use the Platform to promote commercial services, spam, pyramid schemes, or multi-level marketing; or violate any rights of another person including intellectual property rights and privacy rights.
Violations may result in immediate account termination and referral to law enforcement.
8. Prohibited Content
You may not post, upload, share, or transmit any content that:
Is obscene, pornographic, sexually explicit, or contains nudity; depicts, exploits, endangers, or solicits minors in any way — violations involving minors will be immediately reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement; is hateful, discriminatory, or promotes racism, sexism, violence, or bigotry based on any protected characteristic; harasses, defames, threatens, or intimidates any individual; constitutes self-harm promotion, eating disorder glorification, dangerous challenge content, or violent extremism; includes another person’s image or likeness without their explicit consent; discloses another person’s private or personally identifiable information without their consent (“doxxing”); was not created by you or was auto-generated without Friendr’s express permission; infringes any third-party copyright, trademark, trade secret, or other intellectual property right; or is false, misleading, or deceptive in a way that could harm another user or Friendr’s reputation.
Posting Prohibited Content may result in immediate account suspension or termination. Certain violations — particularly those involving minors or credible threats of violence — will be reported to applicable authorities without prior notice to you.
9. Reporting & Appeals
You may report another user’s content or conduct that you believe violates these Terms by using the in-app report feature on any profile or hangout, or by emailing daniel@joinfriendr.com. We review all reports and take action at our sole discretion. We may not share the outcome of moderation decisions with reporters.
If you believe your content or account was actioned in error, you may submit an appeal to daniel@joinfriendr.com with the subject line “Moderation Appeal.” We will review appeals in good faith but are not obligated to restore removed content or reinstated terminated accounts.
Submitting false, bad-faith, or malicious reports — including reports motivated by bias against a protected characteristic — may itself result in enforcement action against the reporting user, up to and including account termination.
10. Subscriptions & Purchases
What the subscription includes: Friendr may offer an optional “Friendr Support” subscription that unlocks cosmetic app themes and supports platform development. The subscription is entirely optional. It confers no advantage in social features, discovery, Hangout creation, Crew membership, or any other core platform function. The core Friendr experience is and will remain free.
Pricing and auto-renewal: Subscription pricing is displayed clearly before purchase. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize Friendr (or Apple / Google, as applicable) to charge your payment method on a recurring basis.
Managing your subscription: If you subscribed via the Apple App Store, you must cancel through Settings > [Your Apple Account] > Subscriptions on your iOS device. If you subscribed via Google Play, cancel through the Google Play app under Account > Payments & Subscriptions. Deleting the App or your account does not automatically cancel a subscription managed through Apple or Google.
Cancellation: You may cancel at any time. Upon cancellation, you retain access to subscription benefits through the end of the current billing period. No prorated refunds are issued for partial billing periods, except where required by applicable law.
Refunds: All purchases are generally final and non-refundable. Exceptions: (a) California, Illinois, New York, and certain other state residents may cancel within 3 business days of subscribing for a full refund; (b) EU/EEA residents are entitled to a full refund within 14 days of purchase under applicable consumer law. To request a refund where applicable, email daniel@joinfriendr.com. Refunds for Apple or Google purchases must be requested through those platforms.
Price changes: We will provide advance notice of any price increase via email or in-App notification before your next renewal. If you do not cancel before the change takes effect, you authorize the new price.
Account deletion: If you delete your Friendr account, any active subscription will be cancelled and you will lose access to subscription benefits. You will not receive a prorated refund unless required by applicable law.
11. Assumption of Risk
You acknowledge and agree that participation in any Hangout or Crew activity organized through the friendr. platform involves inherent and potentially serious risks, including but not limited to personal injury, property damage, illness, emotional distress, or death. Meeting strangers in person carries risk that cannot be fully eliminated. You voluntarily and knowingly assume all such risks and agree that Friendr bears no responsibility whatsoever for any harm, injury, loss, or damage that may result from your participation in any Hangout or Crew activity.
12. Release of Liability
To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Friendr LLC, its members, managers, founders, officers, employees, contractors, agents, successors, and assigns (collectively, “Released Parties”) from any and all claims, demands, causes of action, damages, losses, costs, or expenses of any nature, whether known or unknown, arising out of or in any way connected with your use of the Platform or your participation in any Hangout or Crew activity, regardless of whether such claims arise from the negligence of the Released Parties or any other cause. If you are a California resident, you waive California Civil Code § 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
13. Indemnification
You agree to indemnify, defend, and hold harmless Friendr LLC and its Released Parties from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Platform; (b) your participation in any Hangout or Crew; (c) your User Content; (d) your violation of these Terms; (e) your misrepresentation of your identity, age, or background; or (f) your violation of any rights of another person, including intellectual property rights and privacy rights.
14. No Endorsement of Users
Friendr does not conduct criminal background checks, identity verification, or sex offender registry searches on its users. Friendr does not screen, vet, verify, endorse, or guarantee the identity, background, character, intentions, or fitness of any user. Friendr is not responsible for the conduct of any user on or off the Platform. You are solely responsible for your interactions with other users. Friendr strongly encourages you to meet other users only in public places, tell someone where you are going, and exercise appropriate caution when interacting with strangers.
15. Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FRIENDR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION PROVIDED ON OR THROUGH THE PLATFORM IS ACCURATE, COMPLETE, OR RELIABLE. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FRIENDR LLC OR ITS RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM OR YOUR PARTICIPATION IN ANY HANGOUT OR CREW, EVEN IF FRIENDR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT LIABILITY CANNOT BE FULLY EXCLUDED, FRIENDR’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU ACTUALLY PAID FRIENDR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions, liability is limited to the fullest extent permitted by law.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Nothing in these Terms limits or waives any rights you may have under the mandatory consumer protection laws of your state of residence.
18. Informal Dispute Resolution
Before filing any arbitration claim or lawsuit (except for small claims court), you and Friendr agree to attempt to resolve any dispute informally for at least sixty (60) days. To initiate informal resolution, email daniel@joinfriendr.com with subject line “Dispute Notice” and describe your claim and the relief you seek. Friendr will respond within 30 days. If the dispute is not resolved within 60 days of your notice, either party may proceed to arbitration as described below. This informal process is a prerequisite to arbitration and a court may dismiss any arbitration demand filed without completing it.
19. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
After completing the informal dispute resolution process in Section 18, and except for disputes that qualify for small claims court or that involve Friendr’s intellectual property rights, you and Friendr agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in Cook County, Illinois, or virtually if you and Friendr agree. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Arbitration filing fees shall be governed by the AAA’s Consumer Arbitration Rules; Friendr will pay arbitration costs to the extent required by those rules.
Class Action Waiver: YOU AND FRIENDR EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING OF ANY KIND.
Mass Arbitration: If 25 or more similar arbitration demands are filed against Friendr by the same or coordinated counsel within a 90-day period, the AAA’s Mass Arbitration Supplementary Rules shall apply. In that event, the parties agree to work in good faith to establish an efficient batched arbitration process. Failure to comply with mass arbitration procedures may result in dismissal of the filing.
Opt-Out: You may opt out of this arbitration agreement by emailing daniel@joinfriendr.com with subject line “Arbitration Opt-Out” within thirty (30) days of first creating your account. Opting out does not affect any other Terms.
20. Changes to Terms
Friendr reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms with a new “Last updated” date and providing notice within the App or by email. Material changes to Sections 16 (Limitation of Liability) or 19 (Binding Arbitration) require your affirmative re-acceptance before taking effect. Your continued use of the Platform after other changes become effective constitutes your acceptance of those revised Terms.
